Terms and Conditions

1. Introduction & Acceptance
Welcome to Driky.com (the “Site”), a Wyoming-registered company (“Driky,” “we,” “us,” or “our”). By accessing or using the Site — browsing, placing an order, or otherwise interacting — you (the “User,” “you,” “your,” or “Customer”) agree to be bound by these Terms & Conditions (the “Terms”) in full. If you do not agree to all of these Terms, you must not use the Site or purchase from us.

3. Eligibility
Our services (including purchase of products) are available only to individuals who can form legally binding contracts under applicable law. By using the Site or placing an order, you represent that you are at least 18 years old (or have reached the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement.

4. Products, Orders & Order Acceptance

  • We aim to fulfill all orders placed, but we reserve the right to accept or reject any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraudulent activity.

  • Receipt of an order confirmation (via email or on-screen) does not guarantee acceptance of your order. An order is accepted only when we ship the product (or indicate that it will be manufactured/fulfilled) or otherwise notify you that the order is accepted.

  • We may cancel or refuse to ship any order — including previously confirmed orders — at our sole discretion. If your order is canceled after payment, we will issue a full refund.

5. Pricing & Payment

  • All prices displayed on Driky.com are in U.S. Dollars (USD) and are valid and effective only in the United States, unless otherwise stated.

  • We reserve the right to modify prices at any time and without prior notice (e.g., during promotions, sales, or due to changes in cost). However, once an order is confirmed, the price is fixed for that order.

  • Payment must be completed via the payment methods offered at checkout. By placing an order, you warrant that the payment method is valid, that you are authorized to use it, and that the billing information is accurate.

6. Shipping, Delivery & Risk of Loss

  • We will attempt to deliver the products to the address you provide at checkout. It is your responsibility to ensure the address is correct. We are not responsible for orders delivered to an incorrect address due to your error.

  • Risk of loss and title for purchased items pass to you when we (or our carrier) deliver the items to the shipping address you provided (or if you abandon an order or fail to accept delivery).

  • We will provide tracking information where available. Delivery dates are estimates only; we are not liable for delays due to carrier services, customs, force majeure, or other events beyond our control.

7. Returns, Refunds & Exchanges
(If you offer returns — if not, modify accordingly)

  • If you receive a defective or incorrect item, contact our Support (Support@Driky.com or via phone) within [X] days of delivery with photos and order information. We may request return of the item. Upon verification, we will replace the item or issue a refund (at our discretion).

  • For non-defective items, we may (or may not) allow returns or exchanges depending on promotional status, product type, and condition (e.g., tags attached, unworn, unwashed). Returns or exchanges are subject to prior approval by Driky.

  • You are responsible for return shipping costs unless otherwise agreed upon. Shipping costs incurred for original order or return may not be refundable.

  • Refunds — when issued — will be processed to the original payment method within a reasonable timeframe after approval.

8. Intellectual Property & User Content (if applicable)

  • All content displayed on the Site — text, graphics, logos, images, designs, product photography, layout, software — is the property of Driky or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

  • You may not reproduce, distribute, modify, transmit, display, or create derivative works from any site content — in whole or in part — without our prior written consent.

  • If the Site allows user-generated content (e.g. reviews, custom designs), by submitting such content you grant Driky a non-exclusive, royalty-free, worldwide, sublicensable, transferable license to use, reproduce, display, and distribute that content in connection with our business (including marketing, promotions, and fulfillment).

  • You represent and warrant that any content you submit is your own or you have rights to submit it, does not infringe third-party rights, and does not contain unlawful, defamatory, obscene, or otherwise objectionable material.

9. Acceptable Use & Prohibited Conduct
While using the Site, you agree not to:

  • Use the Site for unlawful purposes or in violation of these Terms or any applicable law;

  • Interfere or attempt to interfere with the functionality of the Site (e.g., by hacking, bots, data scraping, or other disruptive behavior);

  • Transmit harmful, malicious code (viruses, malware, trojans) or attempt to disrupt server communications;

  • Use infringing, deceptive, fraudulent, or unauthorized content, including counterfeit goods, pirated designs, or content that violates third-party rights;

  • Use disclaimers or false attribution that misrepresents affiliation with Driky;

  • Attempt to resell or redistribute content without explicit permission, especially trademarked or protected designs.

Violation of these provisions may result in termination of your access, cancellation of orders, and legal action at our discretion.

10. Disclaimer of Warranties & Limitation of Liability

  • The Site and all products are provided “as is” and “as available,” without warranties of any kind — express or implied (including merchantability, fitness for a particular purpose, non-infringement).

  • We do not guarantee that products will meet your expectations (e.g., for size, fit, color accuracy, design appearance). Colors and sizing may vary due to manufacturing processes, monitor differences, or printing limitations.

  • Driky (and affiliated parties) will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, purchase/use of products, or inability to use the Site — even if advised of the possibility of such damages.

  • In jurisdictions where exclusion or limitation of liability is not permitted, our liability will be limited to the maximum extent permitted by law (e.g., replacement of goods or refund of purchase price).

11. Indemnification
You agree to indemnify and hold harmless Driky, its officers, directors, employees, affiliates, and agents from any claims, damages, losses, liabilities, costs (including reasonable legal fees), and expenses arising out of:

  • Your breach of any provision of these Terms;

  • Your violation of any third-party right (including intellectual property, privacy, publicity, or contract);

  • Your misuse of the Site or products purchased;

  • Any activity related to your account or orders.

12. Modifications of Terms
We reserve the right to update, modify, or replace these Terms at any time — in our sole discretion. When we do, we will post the updated Terms on Driky.com and update the “Last Updated” date. Your continued use of the Site following the posting of changes constitutes your acceptance of the modified Terms.

13. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site — including orders and products — will be resolved exclusively via binding arbitration (unless otherwise required by law). If arbitration is unavailable or unenforceable for a particular dispute, you and Driky agree to submit to the exclusive jurisdiction of the state or federal courts located in Wyoming.

14. Severability & Waiver
If any provision of these Terms is held invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary — the remaining provisions will remain in full force and effect. Failure by Driky to enforce any right or provision under these Terms does not constitute a waiver of that right or provision.

15. Termination & Effect of Termination

  • We may, in our sole discretion, suspend or terminate your access to the Site (or any part of it) at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, lawful operation, or our business interests.

  • Upon termination, your right to use the Site will cease, but all disclaimers, indemnities, limitations of liability, and other provisions meant to survive termination will remain in effect.

  • Termination does not relieve you of any obligation to pay for orders already placed and accepted, or indemnification for actions taken prior to termination.

16. Entire Agreement
These Terms (together with any policies posted on the Site, such as Privacy Policy, Shipping Policy, Return/Refund Policy, etc.) constitute the entire agreement between you and Driky regarding the Site and your purchases, and supersede any prior or contemporaneous communications, agreements or representations.

17. Other Policies & Consumer Disclosures
You acknowledge that other policies may apply — including but not limited to our Privacy Policy, Cookie Policy (if applicable), Shipping Policy, Return/Refund Policy. These policies are incorporated by reference into these Terms. By using this Site or placing an order, you agree to all such policies.
